KAIMANA HEALING, LLC d/b/a WILD JOY PROJECT BOOKING TERMS AND CONDITIONS

Effective date: November 2026

1. Agreement

These Terms and Conditions ("Terms" or "Agreement") govern all trips, tours, and travel services (each, a "Trip") planned, arranged, coordinated, or booked with Kaimana Healing, LLC, a Delaware limited liability company doing business as Wild Joy Project (also referred to as "we," "us," or "our"). "Participant," "you," or "your" refers to each individual who registers for or participates in a Trip.

By submitting a registration, making a payment, paying a deposit, or participating in a Trip, Participant agrees to be bound by this Agreement and by Wild Joy Project’s Liability Waiver and Release, Assumption of Risk and Indemnification Agreement (“Liability Waiver and Release”), which is incorporated by reference in this Agreement. The terms and conditions that appear in this Agreement constitute the entire understanding and agreement between you and Kaimana Healing, LLC. These Terms and our separate Liability Waiver and Release must be signed before you may participate in a Trip. If you fail to submit these Terms and other necessary documentation, including any required medical statements, prior to departure, Wild Joy Project reserves the right to treat the booking as cancelled by you and impose cancellation fees.

By submitting a booking form, agreeing to these Terms, or submitting a deposit, you accept all of the terms in this Agreement and direct us to perform services on your behalf. All Participants named in a booking must separately accept this Agreement and execute Wild Joy Project’s Liability Waiver and Release. By signing this Agreement, you affirm that you have made all other Participants listed in the booking aware of these Terms, regardless of how payment is made, and that all such Participants accept these Terms.

2. Registration and Booking Confirmation

You may reserve space on a Trip by booking via our web portal. A Participant’s booking is preliminarily confirmed upon Wild Joy Project's receipt of a completed registration and the required Trip deposit. A booking is not final until you receive a written confirmation from us. A Participant's participation in the Trip is contingent upon: (a) Wild Joy Project's receipt and review of all required and executed forms, including these Terms, Wild Joy Project’s Liability Waiver and Release, any required health disclosures; and (b) Participant's full and timely payment of the Trip cost by the final payment due date stated on the trip sales page, which also includes instructions for payments, the associated payment schedule, and other important information about your Trip (“Booking Details”). To the extent any terms in your Booking Details conflict with a term in this Agreement, the terms in the Booking Details will control.

3. Payment Terms

Deposit and Subsequent Payments. For most Trips, a non-refundable deposit of $500 per Participant is due when the booking is submitted; a different deposit amount may apply if disclosed in the Booking Details before booking. Unless the applicable Booking Details state otherwise, the outstanding Trip balance is due in full no later than 90 days before the scheduled departure date. If you book within 90 days before the scheduled departure date, the full Trip price is due when you submit your booking unless the applicable Booking Details state otherwise. In that case, $500 of the amount paid (or such other deposit amount stated in the Booking Details) constitutes the non-refundable deposit, and the remainder is subject to the cancellation and refund policy in Section 4 of this Agreement. The payment of the deposit secures Participant's spot, including Participant's room; Wild Joy Project will not hold a room for Participant until the deposit is paid. The deposit is non-refundable and non-transferable unless Wild Joy Project and Participant mutually agree in writing or in the specific circumstances specified in the paragraph named “Cancellations and Changes by Wild Joy Project” in Section 4, of this Agreement.

In all cases, the deposit is not a penalty. It reflects costs and commitments Wild Joy Project incurs once a booking is submitted, including, without limitation, reserving limited Trip capacity and removing it from sale to others, supplier deposits and commitments, and planning and administrative work, the full amount of which is difficult to determine in advance. You agree that the deposit is a reasonable estimate of those costs.

Payment Schedule. The balance of the Trip price remaining after the deposit shall be paid by Participant to Wild Joy Project in two equal payments, billed separately. The payment due dates are listed in the Booking Details. Participant must pay Wild Joy Project in accordance with the payment schedule and instructions disclosed in the applicable Booking Details. Invoices will be sent approximately one month prior to each payment being due. Optional activities will be invoiced separately if Participant chooses to participate. By providing a payment method, you represent that you are authorized to use it and authorize Wild Joy Project and its payment processors to charge it for all amounts due under the applicable Booking Details. If you fail to make any payment when due, Wild Joy Project may cancel your booking and apply the cancellation and refund terms stated in these Terms and the applicable Booking Details. Additional late booking fees may apply for bookings made within 30 days of your departure date unless otherwise provided in your Booking Details. Wild Joy Project reserves the right to refuse any booking, in which case any amount paid for that booking will be refunded. If you believe a charge is incorrect, you must promptly notify Wild Joy Project and provide sufficient information and a reasonable opportunity to investigate and resolve the issue before initiating a payment dispute or chargeback.

All payments are due in US Dollars unless otherwise specified in writing. We accept payment by credit card and ACH deposit. We do not accept cash.

4. Cancellations, Changes, Refund Policy

Refunds for Participant-initiated cancellations are governed by the schedule and related terms below.

Cancellation by Participant. To cancel a confirmed booking, you must submit your request to us in writing by email at alyssa@wildjoyproject.com and write “Booking Cancellation” in the subject line. Cancellations are only effective when we receive your written notification of cancellation. The cancellation date is the date Wild Joy Project receives your written notice.

Days Before Departure

Refund Amount

120 days or more before the scheduled departure date: Full refund of amounts paid minus non-refundable deposit

91-120 days before the scheduled departure date: 50% of the Trip Cost minus non-refundable deposit

90 days or less before the scheduled departure date: No refund; Wild Joy Project retains all amounts paid and may collect any unpaid balance

Once Wild Joy Project confirms your booking, the cancellation terms in this section and the applicable Booking Details apply regardless of the reason for cancellation, including illness, injury, or other medical circumstances. Except for refunds expressly provided under this section or the applicable Booking Details, you will not be entitled to a refund for any unused portion of travel, including if you leave a Trip after it begins, miss the Trip’s departure, or are removed from a Trip.

Due to the nature of government fees, Supplier contractual agreements and operator permits, Wild Joy Project must adhere to a strict cancellation policy. Unless Wild Joy Project agrees otherwise in writing or the applicable Booking Details expressly provide otherwise, the cancellation and refund terms apply without exception to Participant-initiated cancellations, including cancellations arising from fear of travel, travel warnings or advisories, weather, terrorism, civil unrest, illness, injury, or other medical circumstances or emergencies, or personal or family emergencies or circumstances. As such, we strongly recommend that you purchase comprehensive travel insurance to help protect your financial investment, covering medical evacuation and repatriation; emergency medical expenses; baggage loss; and travel delay.

Unless this section or the applicable Booking Details expressly requires a full refund, any refund is subject to non-refundable fees, surcharges, and other charges actually imposed and retained by Suppliers (“Supplier Fees”). Upon receipt of a cancellation by you, we will communicate on your behalf with any Supplier and review the cancellation subject to their individual policies. However, Supplier Fees may be non-refundable in whole or in part under the applicable Supplier’s policies. Except where this section requires Wild Joy Project to provide a specified refund, any refund will be reduced by documented, non-refundable Supplier Fees and will not exceed the amount Wild Joy Project recovers from the applicable Supplier for Participant’s booking.

Changes by You. Changes can be disruptive to a Trip, not possible, or very costly. Wild Joy Project may, in its sole discretion, accommodate changes in bookings (e.g., shifted dates and updated activities). If you change your Trip dates or alter your itinerary after we confirm your Trip, a change fee will be imposed if we are able to accommodate the change. The type and scope of change, as well as Wild Joy Project’s reasonable administrative costs, dictate the amount of the change fee. Changes to a booking made more than 30 days after the original booking may be treated as a cancellation subject to the cancellation terms in this section, or may require a new payment schedule, at the sole discretion of Wild Joy Project. Our outside Suppliers (“Suppliers”), including hotels, often impose additional fees or penalties for changes and cancellations. These are included in the change fee and can be substantial.

Cancellations and Changes by Wild Joy Project. Wild Joy Project and its Suppliers may cancel, alter, modify, postpone, or reschedule any Trip without prior notice for Participant safety or comfort, insufficient enrollment, Supplier changes, or Force Majeure under Section 7. Should your Trip be canceled, altered, modified, postponed, or otherwise rescheduled, we will, as soon as reasonably possible, notify you of available alternatives. You will likewise be advised of any changes to your

Trip that may require a supplemental payment from you. If Wild Joy Project cancels a Trip prior to departure (other than due to Participant’s fault or Force Majeure), Wild Joy Project’s sole obligation is to refund payments, including the deposit, received by Wild Joy Project within 30 days of the cancellation.

Wild Joy Project is not liable for any consequential, incidental, or indirect damages arising from a cancellation or modification, including but not limited to non-refundable airfare or lost wages.

Minimum Participant Requirement. Each Trip requires a minimum number of participants, as stated in the Booking Details. If the minimum number of participants is not met by 70 days before the Trip's departure date, Wild Joy Project reserves the right to cancel the Trip, and Participant's deposit and any payments made will be refunded in full, less any non-recoverable third-party deposits, or, at Participant’s election if Wild Joy Project offers this option in its sole discretion, a credit toward a future Trip. No refunds under this section will be provided due to cancellations or changes to a Trip due to Force Majeure. Refunds and credits for a cancellation or change caused by Force Majeure are governed exclusively by Section 7 of this Agreement.

Price Adjustments. The quoted Trip price is based on tariffs, fees, airfares, and costs in effect at the time you sign this Agreement. Wild Joy Project may increase the quoted price after booking if inflation, costs of fuel, labor or materials, airfares, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change that occur after booking and are beyond Wild Joy Project’s reasonable control. Wild Joy Project will give Participant written notice describing the basis and amount of any price increase before charging it. If cumulative post-booking price increases exceed 10% of the original Trip price, Participant may cancel within seven (7) days after notice and receive a refund of amounts paid, less documented, non-refundable Supplier Fees, or accept any postponement or alternative Trip Wild Joy Project offers.

Credit Card Authorization for Post-Booking Charges. You authorize us to charge the credit card that you have on file with Wild Joy Project for any change fees, price increases, or supplemental payments that you incur post-booking. If you prefer a different payment method, you must notify us in writing at the time of booking.

No Refunds for Personal Expenses. You will not be reimbursed for any personal expenses such as airfare, hotel, or other travel expenses due to changes in itineraries or Trip cancellation unless otherwise agreed upon in advance and in writing by Wild Joy Project or noted in the Trip Booking Details. Any purchases that you make from third parties during the Trip are your full responsibility and are made at your own risk.

No Refunds for Unused Trip Services. You will not be refunded, provided a credit, or reimbursed for Trip services that you do not use because you arrived late, left early, missed an activity or service, chose not to participate, or otherwise did not use part of the itinerary. Any additional nights, side trips, activities, meals, transportation, or other arrangements not expressly included in the itinerary are Participant's sole responsibility to arrange and pay for, whether booked through Wild Joy Project as an accommodation to Participant or independently by Participant. Wild Joy Project assumes no responsibility for arrangements made independently by Participant, including before or after the scheduled Trip dates.

Except as expressly provided in Section 7 regarding Force Majeure, this section exclusively governs Participant-initiated cancellations and related refunds.

5. Trip Itinerary; Scope of Wild Joy Project’s Services

The itinerary published for each Trip describes the accommodations, transportation, activities, and other services Wild Joy Project will arrange or provide as part of the Trip price (“Included Services”). Wild Joy Project is responsible only for the Included Services expressly identified in the applicable Trip itinerary. Tips for the room and all included activities are included in the Trip price; Participants are encouraged to tip the staff for any optional activities in which they participate. Any additional nights, side trips, activities, meals, transportation, or other arrangements not expressly included in the itinerary are Participant’s sole responsibility and are paid for separately, whether booked through Wild Joy Project as an accommodation to Participant or arranged independently by Participant. Where an optional activity is booked through us, we will make all necessary arrangements for that activity, including transportation, and will invoice Participant separately. Wild Joy Project assumes no responsibility for arrangements made independently by Participant, including before or after the scheduled Trip dates. For clarity, the Trip price covers only the Included Services and scheduled nights expressly identified in the applicable Trip itinerary. If a Force Majeure event requires Participant to remain at an existing location, obtain additional lodging, or use substitute arrangements beyond those Included Services, those additional arrangements are not included in the Trip price unless Wild Joy Project expressly states otherwise in writing.

6. Wild Joy Project's Role and Independent Third-Party Suppliers

Wild Joy Project organizes and operates travel programs, tours, and itineraries. Our services include itinerary design, group coordination, activity planning, and coordination with third-party independent suppliers, including but not limited to accommodation providers, transportation providers, restaurants, hotels, guides, destination management companies (DMCs), and local operators. Our Suppliers require payment well in advance of the Trip date and by making a booking, you are subject to both our and our Suppliers’ terms and conditions.

Wild Joy Project selects Suppliers using reasonable care but does not own, operate, manage, employ, or control any Supplier. Wild Joy Project acts as the Trip organizer and Participant's point of contact in the United States. Wild Joy Project is not responsible for the acts, omissions, negligence, or default of any Suppliers. You acknowledge that you are aware of and clearly understand that Wild Joy Project assumes no responsibility for these Suppliers, who are independent contractors, and are not managed by Wild Joy Project. We are not responsible for the financial default of any Suppliers. We have no special knowledge of a Supplier’s financial condition.

7. Force Majeure

Wild Joy Project will not be deemed in breach of these Terms or otherwise liable to you, including for any refund of a Trip deposit, by reason of delay in performance or nonperformance of any of its obligations under this Agreement to the extent that such delay or nonperformance is due to Force Majeure. While we are committed to working with you and our Suppliers to find a workable solution in the event of Force Majeure, our obligations are limited to those described in this section.

“Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances. Participant acknowledges that weather and other travel conditions are inherently unpredictable and may cause delays, itinerary changes, additional hotel stays, or other unexpected expenses. Participant must travel prepared for such disruptions by maintaining access to sufficient emergency funds and is strongly encouraged to obtain travel insurance covering weather-related delay, interruption, and additional accommodation and transportation expenses.

In the uncommon situation where Force Majeure prevents, significantly hinders, renders it difficult, or makes it impossible for us or our Suppliers to provide services, including but not limited to your Trip, we and/or our Suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: vary, reschedule, postpone, or cancel any trip itinerary or arrangement, including trip dates and the entire Trip itself. If your Trip is affected by Force Majeure, we will notify you of the nature and extent thereof if practicable. We will also work on your behalf to provide an alternative trip, or obtain travel credits or refunds from our Suppliers of any monies previously remitted to said Suppliers for your Trip. If successful, we will remit to you any refunds to the extent obtained by our Suppliers. We are not responsible for any additional compensation or reimbursement for costs, or expenses you incur as a result.

If Force Majeure prevents or materially delays the group from reaching or using accommodation or other Included Service, Wild Joy Project may, in its reasonable discretion, arrange substitute or additional accommodations, transportation, meals, or other services to protect the safety and continuity of the Trip. Unless Wild Joy Project expressly agrees otherwise in writing, Participant is responsible for the reasonable, documented incremental cost of any substitute or additional service provided after the Included Services originally purchased for Participant have been exhausted, including additional hotel nights required because the group cannot proceed to the next scheduled accommodation. Wild Joy Project may require payment before arranging or continuing those services. Any amounts paid by Wild Joy Project for unused original accommodations or other Included Services will be pursued from the applicable Supplier and credited or refunded to Participant only to the extent actually recovered, and Participant will not receive a duplicate credit or refund for the same service.

Regarding civil unrest, once we have investigated the prevailing situation, as we deem fit, it shall remain in our sole and absolute discretion whether to proceed with the trip. Further, we will provide alternatives or refunds to the extent obtained by our Suppliers for any delay, change, cancellation, overbooking, or strike by our independent suppliers who provide various goods and services connected with your Trip, including lodging, meals, transportation, sightseeing, and activities.

Health Clause: Suppliers and government entities may quarantine, isolate, deny entry to or take other measures involving clients with symptoms of infectious diseases or illnesses aboard confined modes of transport such as ships or trains. While Wild Joy Project will make reasonable efforts to refund amounts paid by Participant, you acknowledge and accept that no refunds will be provided to you for any unused portion of travel, damages or losses or other claims if you are quarantined. Wild Joy Project is not responsible for any costs, damages or losses incurred by you in the event you are quarantined or otherwise interrupted from completing your Trip or using portions thereof.

8. Health, Fitness, and Medical Disclosure

By booking and participating in a Trip, Participant represents and warrants that:

  • Participant is in good physical and mental health and is medically and physically fit and able to participate in the activities included in the booked itinerary;

  • Participant must comply fully with all health and safety requirements introduced by Wild Joy Project;

  • Participant is advised to disclose to Wild Joy Project in writing, prior to departure, any physical condition, disability, dietary requirement, medication, or other health circumstance that may affect participation or require accommodation;

  • Participant is advised to seek a doctor’s advice before participating in the Trip if they have pre-existing injuries or illnesses;

  • Participant is responsible for assessing when they feel any pain or illness during the Trip and informing Wild Joy Project of such pain or illness; and

  • Participant assumes full responsibility for consulting a qualified physician regarding the health and vaccination requirements, recommendations, and risks associated with the destinations and activities included in the Trip.

If you fail to provide the disclosures required by this section, we reserve the right to treat the booking as cancelled by you. Wild Joy Project, or the local operator or guide, shall make the ultimate determination of an individual Trip Participant's fitness to embark upon, or to continue a trip. At any time during the Trip, including at departure, Wild Joy Project as well as the local operator or guide, has the right to remove anyone who it judges to be incapable of meeting the rigors and requirements of participating in the trip activities. Once a trip has been confirmed, medical circumstances will not be considered as exceptions to our cancellation policy.

9. Minimum Age Requirement

Participant must be 18 years or older to participate in the Trip. Participant represents that Participant meets the minimum age specified for the Trip for which Participant is registering.

10. Passport, Visa, and Entry Documentation

Participant is solely responsible for obtaining and carrying documentation of citizenship, a valid passport and any visa, UK electronic travel authorization (“ETA”), European Travel Information and Authorization System (“ETIAS”), Europe's Entry/Exit System (“EES”), and any other electronic travel information/authorization required for each destination and transit country on the Trip. Many countries require a passport to remain valid for a minimum period beyond the return date, commonly six months. Entry requirements vary by destination, change without notice, and are Participant's responsibility to confirm with the relevant embassy, consulate, or official government resource before departure. Participant is also solely responsible for any adverse consequences resulting from missing or defective documentation. While we may provide information or advice on visas, vaccinations, climate, clothing, baggage, special equipment, etc., it is in good faith as a courtesy to you, and we are not responsible for any errors or omissions as to the information provided. We encourage U.S. citizen travelers to register with the Smart Traveler Enrollment Program (STEP), https://mytravel.state.gov/s/step, which is a free service to allow U.S. citizens and nationals to enroll their trip abroad so the Department of State can accurately and quickly contact them in case of emergency.

11. Local Currency and Payment Abroad

Participant acknowledges that Trip destinations may not accept U.S. currency. While major credit cards are accepted in many locations, Participant's financial institution may charge foreign transaction fees, and not all vendors, particularly in rural or remote areas, accept credit cards. Participant is responsible for obtaining and carrying appropriate local currency as needed before and during the Trip.

12. Accommodations

Wild Joy Project selects accommodations with care, but accommodations, particularly in villas or other house-like properties, vary in size, configuration, and amenities. You understand that your room may differ in shape and size from another Participant’s room. Rooms are assigned based on availability and are not customizable on request absent a confirmed upgrade. Amenities such as air conditioning or hairdryers may not be available at every property. Trip leaders are not able to change room assignments once they are made. Participant acknowledges that their Trip accommodations, while selected for quality and character, may not meet five-star hotel standards, particularly on Trips to rural or remote destinations.

13. Roommate and Shared Room Policy

A Participant selecting a shared room should do so only if comfortable rooming with another Trip participant. If Wild Joy Project reasonably determines that a Participant’s conduct materially and repeatedly disrupts a roommate after notice and a reasonable opportunity to correct the conduct, Wild Joy Project may reassign either Participant or require the disrupting Participant to move to a private room, subject to availability, at the disrupting Participant’s expense. Conduct that may be disruptive includes late-night phone use and talking, snoring or use of a noisy machine at night, playing music, or returning to the room late and disturbing others. However, disability-related aids, medically necessary equipment, including a CPAP machine, will not by themselves constitute disruptive conduct. A Participant who wants guaranteed private accommodations should select the private room option at registration.

14. Participant Responsibilities and Conduct

Scope. This section applies from the time an inquiry or booking is made and throughout the planning and booking process, before travel begins, and continues through the completion of the Trip.

Participant Responsibilities. Participant is responsible for:

  • Obtaining and maintaining a valid passport (valid for at least six months beyond the duration of the Trip), visas, and any other entry or travel documents required for all destinations on the itinerary;

  • Paying tips or gratuities for optional activities;

  • Complying with all laws, regulations, and customs requirements of the places visited;

  • Arriving at departure points and meeting points at the times specified in the itinerary;

  • Behaving in a manner that does not endanger the safety or enjoyment of other Participants or Wild Joy Project's personnel (drug use is strictly prohibited on our Trips), and not using any accommodation or property for any offensive, noisy, dangerous, illegal, immoral, or improper purpose or in a manner that is a nuisance or annoyance to others;

  • Keeping all accommodation, fixtures, furniture, and effects in a clean and good condition, and replacing any article that is destroyed or missing with an article of a similar kind and of equal value; and

  • Notifying Wild Joy Project of any special needs (e.g., required medical equipment), dietary restrictions (e.g., food allergies), medications, accessibility requirements, or pre-existing medical or other conditions that may impact travel or help determine whether a Trip is suitable.

Special requirements may affect the Trip, including the booking process. Not all destinations apply the same standards as the United States with respect to accommodating special needs. Wild Joy Project is not liable for Participant being refused entry to any country due to incorrect or invalid travel documents, and is not responsible for any loss of or damage to Participant's personal possessions or valuables.

Punctuality. It is your responsibility to be ready to go to the departure city at the specific trip departure day and time. We are not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures. Trips often depend on group transportation with fixed departure times, including minibuses, ferries, boats, and trains. The group cannot wait for a late Participant. A Participant who is late for a scheduled departure may be left behind and is responsible for arranging and paying for their own transportation to rejoin the group.

Standards of Conduct. On guided Trips, the decision of the local guide or Supplier is final on all matters that may threaten safety or interfere with the well-being of the group or individual Participants. Wild Joy Project and its Suppliers reserve the right, at all times covered by this section, to remove from any Trip, or to terminate the use of any property or facilities by, any Participant whose conduct, in Wild Joy Project's and its Suppliers' sole discretion, is disruptive, dangerous, unlawful, or incompatible with safety, welfare, cultural norms, or group travel. This includes behavior that may adversely affect the safety, security, privacy, comfort, enjoyment, or well-being of other Participants or any Wild Joy Project representatives or Suppliers.

Termination Before Departure. Before a Trip begins, Wild Joy Project may, in its sole discretion, terminate its relationship with Participant, cancel the booking, and discontinue all further services if Participant engages in conduct or otherwise materially fails to meet the responsibilities in this section and Agreement. On such a termination, Wild Joy Project is entitled to retain all amounts paid, including the non-refundable deposit, and, to the extent not yet paid, the Participant remains liable for:

  • any non-refundable payments and cancellation or change penalties already committed to or imposed by airlines, accommodations, or other third-party Suppliers that Wild Joy Project cannot recover, re-use, or cancel without cost;

  • fees for services already performed or otherwise earned by Wild Joy Project and its Suppliers, including planning, design, booking, and coordination services; and

  • any other reasonable costs Wild Joy Project and its Suppliers incur as a result of the booking or the termination.

Removal During the Trip. Once a Trip is underway, Wild Joy Project and its Suppliers reserve the right to remove from the Trip any Participant whose conduct, in Wild Joy Project's and its Suppliers' sole discretion, falls within this section. A Participant removed on these grounds is not entitled to any refund, all further services through Wild Joy Project and its Suppliers will be discontinued, and the Participant is responsible for all costs of departure and onward or return travel following removal. Wild Joy Project shall not accept any consequential liability, damages, or loss arising from such removal.

15. Communication, Connectivity, and Safety Requirements

Wild Joy Project uses messaging apps such as WhatsApp to communicate with Participants and monitor group safety during the Trip. Participant is required to have an international data plan, eSIM, or local SIM card providing internet access throughout the Trip, including outside of hotels, in place before the Trip begins. This requirement exists for Participant's safety and the safety of trip leaders and the group. Participant acknowledges that Wild Joy Project’s ability to reach Participant, and to respond in an emergency, may be delayed or impaired if Participant does not maintain this connectivity.

16. Transportation

Any transportation reservations made through Wild Joy Project, whether by air, rail, bus, ferry, or other carrier, are handled solely in our capacity as an agent. All such transportation is governed exclusively by the applicable carrier’s or operator’s own terms and conditions of carriage, and by making or using any such reservation you agree to be bound by those terms. Fares and charges are subject to change without notice until tickets are issued, and many fares are subject to penalties for changes and cancellations. We do not guarantee any carrier’s fares, schedules, seat or seating assignments, baggage allowances or fees, equipment or aircraft type, or any other carrier-controlled service.

Wild Joy Project accepts no responsibility for, and is not liable for losses arising from, any delay, cancellation, schedule change, missed connection, modified itinerary, or other disruption of any flight, train, bus, ferry, or other form of transport, or for any unused portion of your Trip resulting from carrier actions or schedule changes, whether or not the transportation was booked through Wild Joy Project. Any cancellation of transportation booked on your behalf is subject to the carrier’s cancellation policies, including any penalties imposed, and you are ultimately responsible for any reservations, changes, cancellations, penalties, or disputes with the applicable carrier, regardless of whether Wild Joy Project assisted with the booking.

It is your sole responsibility to ensure that any transportation you purchase for the Trip aligns with the Trip itinerary, including securing appropriate arrangements to arrive at the designated starting point and to return home from the final destination as outlined in the Trip itinerary. If you purchase transportation on your own, you must wait until your Trip booking is confirmed before doing so. Wild Joy Project is not liable for any change fees, cancellation fees, penalties, or other costs you incur from any carrier in connection with your Trip.

17. Travel Insurance

Participant is STRONGLY ADVISED to obtain comprehensive travel, cancellation, and medical insurance before departure that includes, at minimum, coverage for: trip cancellation and interruption; medical evacuation and repatriation; emergency medical expenses; baggage loss; and travel delay.

Wild Joy Project offers travel protection plans through its preferred Suppliers, Travelex Insurance Services. Travel protection plans are also available from other insurers. We strongly recommend the purchase of "Cancel for Any Reason" (CFAR) insurance where available. Wild Joy Project is not an insurance company, insurance producer, or insurance expert. It does not accept payment for travel protection plans. While Wild Joy Project may provide general information about travel protection plans such as price and a description of coverage, it cannot and does not answer technical questions about the terms and conditions of the travel protection plans offered by its preferred Suppliers. Nor can it or does it evaluate the adequacy of your existing travel protection plan coverage. You acknowledge and agree that you must direct those questions to the Suppliers.

If you purchase a travel protection plan through Wild Joy Project’s preferred Suppliers, you acknowledge that you have reviewed and understand the exclusions and limitations of the travel protection plan policy and are satisfied with the levels of coverage offered and/or provided to you.

Wild Joy Project is not responsible for any cost or loss that adequate travel insurance would have covered. The decision whether to purchase insurance is Participant's own, and the absence of insurance does not alter or supersede the applicable payment, cancellation, or refund terms.

Certain Trips may require travel insurance as a condition of participation. Any mandatory insurance requirement, including applicable minimum coverage requirements, will be stated in the Booking Details at the time of registration. When insurance is not required, a Participant who chooses to travel without insurance accepts the financial risks associated with doing so. The absence of insurance does not alter or supersede the applicable payment, cancellation, or refund terms.

18. Assumption of Risk

Participant acknowledges and accepts the risks inherent in the activities included in the Trip, including but not limited to: uneven terrain, loose rock, trail hazards, inclement weather, exposure to extreme temperatures, physical overexertion, falls, animal encounters, and limited access to emergency medical services in remote locations, together with the general risks of international travel, including unfamiliar transportation systems, differing safety and regulatory standards abroad, and political or civil conditions outside Wild Joy Project’s control. Participant acknowledges that these risks cannot be eliminated without fundamentally altering the nature of the Trip's activities. This assumption of risk is set out more fully in the accompanying Liability Waiver and Release.

19. Guide Non-Representation

Guides and trip leaders are selected by Wild Joy Project based on our internal criteria, which may include experience, local knowledge, language skills, and other relevant factors. Wild Joy Project does not warrant that any guide holds a particular government-issued license, professional certification, or formal qualification unless expressly stated in the Trip's registration materials for that specific Trip. Participant acknowledges that guide and trip leader qualifications vary by destination and activity type.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WILD JOY PROJECT TO PARTICIPANT OR PARTICIPANT’S HEIRS AND ASSIGNS FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL BE LIMITED TO THE TOTAL AMOUNT OF FEES PAID BY PARTICIPANT TO WILD JOY PROJECT FOR THE SERVICES GIVING RISE TO THE LIABILITY OR $10,000, WHICHEVER IS GREATER. IN NO EVENT SHALL WILD JOY PROJECT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. NOTHING IN THIS AGREEMENT LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

Destinations visited on a trip may not have accessibility infrastructure, facilities, or standards equivalent to those in the United States. Wild Joy Project makes no representation that any destination, venue, accommodation, or activity is accessible to persons with mobility limitations or disabilities. IT IS PARTICIPANT'S SOLE RESPONSIBILITY TO ASSESS WHETHER A TRIP IS SUITABLE FOR PARTICIPANT'S INDIVIDUAL NEEDS.

Participants with questions about whether a specific trip is suitable for their individual needs are encouraged to contact Wild Joy Project before booking. Wild Joy Project will make reasonable efforts to provide accurate information about the physical demands and accessibility of each Trip.

Each Trip is designed for Participants who meet the physical fitness and health requirements described in that trip's itinerary. These requirements are based on the objective physical demands of the activities and apply equally to all Participants, regardless of age, disability status, or any other characteristic.

21. International Travel

For Trips that include travel to or through countries outside the United States, Participant additionally acknowledges:

  • Travel to foreign destinations involves risks, including political instability, infrastructure limitations, differing standards of medical care, and limited emergency services, which are beyond Wild Joy Project’s control and that Wild Joy Project cannot mitigate or eliminate;

  • Wild Joy Project does not warrant the quality, safety, or compliance with US standards of any accommodation, transportation, activity, or service provided in a foreign country;

  • Participant is responsible for reviewing current US Department of State travel advisories for all destinations on their itinerary and for making an independent assessment of the risks of travel;

  • In the event of a medical emergency or evacuation in a foreign country, Participant is solely responsible for the costs of emergency medical care and evacuation unless covered by applicable insurance;

  • Wild Joy Project’s local Suppliers in foreign destinations operate under the laws and standards of their respective countries, not US law.

Wild Joy Project selects its Suppliers and designs and operates its Trips with reasonable care, and reviews publicly available safety and risk information, including U.S. Department of State travel advisories, in planning its itineraries. ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE TRIP SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY AAA UNDER ITS THEN-APPLICABLE RULES. THE ARBITRATOR, AND NOT ANY FEDERAL, STATE, OR LOCAL COURT, SHALL HAVE EXCLUSIVE AUTHORITY TO RESOLVE ANY DISPUTE RELATING TO THE INTERPRETATION, APPLICABILITY, ENFORCEABILITY, OR FORMATION OF THIS ARBITRATION PROVISION, INCLUDING ANY CLAIM THAT ALL OR PART OF IT IS VOID OR VOIDABLE. THE PARTIES EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE ACTION.

This arbitration clause does not prevent either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

Fees and Costs. Each party shall bear its own attorneys’ fees and costs incurred in connection with the arbitration, and the parties shall share equally the fees and costs of the arbitrator and the AAA, except that nothing in this provision limits any right a party may have to recover attorneys’ fees or costs where such recovery cannot be waived or is expressly authorized by applicable law.

Confidentiality. The parties shall keep confidential the existence, content, and result of the arbitration, including all filings, submissions, evidence, and the award, and shall not disclose any of the foregoing to any third party without the other party’s prior written consent. This provision does not apply to disclosures required by law, subpoena, or court order, or reasonably necessary to confirm, vacate, or enforce the award or to seek the equitable relief permitted above. A party may also disclose such information, on a confidential basis, to its attorneys, accountants, insurers, and other professional advisors who need to know it. Nothing in this provision prevents a party from raising a genuine health, safety, or legal concern with any appropriate authority, reporting to or communicating with any government agency, or exercising any right that cannot legally be waived or limited under applicable law. The arbitrator shall retain jurisdiction to resolve any dispute concerning this provision.
